1. Agreement to Terms

By accessing or using Camberly (camberly.co.za), including our website, progressive web application (PWA), and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our platform.

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, No. 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act, No. 25 of 2002 ("ECT Act"), and the Protection of Personal Information Act, No. 4 of 2013 ("POPIA").

2. Description of Services

Camberly is a free, mobile-first platform for South African car owners. We currently provide the following services:

  • Maintenance Guides — Written guides covering car care, diagnostics, and maintenance topics.
  • Blog & News — Articles about the South African automotive industry.
  • Video Tutorials — Step-by-step video tutorials for car maintenance tasks.
  • Workshop & Installer Discovery — A searchable directory of approved workshops and installers across South Africa.
  • Calculator Tools — Client-side calculators including a fuel cost calculator, loan deal analyser, traffic fine lookup, and cost of ownership calculator. These tools use publicly available South African reference data (Department of Energy fuel prices, prime lending rate, AARTO fine schedules, provincial admin fees).
  • Knowledge Dictionary — A searchable database of automotive symptoms, components, and terminology.
  • Help Centre — Support articles about using the platform.

3. User Accounts

Many features of Camberly are available without creating an account. However, certain features — such as saving vehicles, tracking reading progress, and accessing your search history — require you to register.

When you create an account, you agree to:

  • Provide accurate and complete registration information.
  • Keep your login credentials secure and confidential.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that appear to be used for fraudulent or malicious purposes.

4. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorised access to our systems, databases, or other users' accounts.
  • Scrape, crawl, or use automated tools to extract data from the platform beyond what is permitted by our robots.txt or without our written consent.
  • Submit false, misleading, or spam content through any forms, including vendor registration.
  • Interfere with or disrupt the platform's infrastructure, including circumventing rate limits.
  • Impersonate another person or entity, or misrepresent your affiliation with a business.
  • Reproduce, distribute, or republish our content (guides, blog posts, tutorials) without our express written permission.

5. Calculator Tools & Reference Data

Camberly provides calculator tools — including fuel cost estimation, loan analysis, traffic fine lookup, and cost of ownership calculation — for informational purposes only. These tools are designed to give you helpful estimates, not professional financial, legal, or mechanical advice.

Important disclaimers:

  • Fuel prices are sourced from the South African Department of Energy and are updated periodically. Actual pump prices may vary by region and retailer.
  • The loan analyser uses the South African prime lending rate for comparison purposes. It does not constitute financial advice. Always consult a qualified financial adviser before making borrowing decisions.
  • Traffic fine amounts are based on the AARTO schedule and may not reflect final amounts imposed by courts or authorities. Fine amounts, demerit points, and processes are subject to change by government.
  • Licence and admin fees are sourced from provincial fee schedules and may change without notice.
  • Cost of ownership estimates are approximations based on the inputs you provide and should not be relied upon as exact figures.

Camberly makes reasonable efforts to keep reference data current but does not guarantee its accuracy or completeness at any given time.

6. Workshop & Provider Directory

Camberly lists workshops and installers as an informational directory. We review provider registrations before approval, but:

  • We do not endorse, guarantee, or certify the quality, safety, or legality of any listed provider's services.
  • We are not a party to any transaction or agreement between you and a service provider.
  • We are not responsible for any loss, damage, or injury resulting from services provided by a listed workshop or installer.
  • Provider information (hours, services, contact details) is supplied by the providers themselves and may not always be up to date.

You should always conduct your own due diligence before engaging any service provider.

7. Content & Guides Disclaimer

Our maintenance guides, tutorials, and blog posts are provided for general informational and educational purposes only. They are not a substitute for professional mechanical advice or service.

  • Always consult a qualified mechanic for complex repairs or safety-critical work.
  • Follow your vehicle manufacturer's official service manual and recommendations.
  • Camberly is not liable for any damage, injury, or loss resulting from following our guides or tutorials.

8. Intellectual Property

All content on Camberly — including text, graphics, logos, icons, images, guides, tutorials, blog posts, and software — is the property of Camberly or its content creators and is protected by South African copyright law.

You may view and use our content for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without our prior written consent.

9. Vendor & Provider Terms

If you register as a service provider (workshop or installer) on Camberly, you additionally agree to:

  • Provide accurate, truthful business information including your operating address, contact details, and services offered.
  • Keep your listing information up to date and notify us of any material changes.
  • Accept that your registration is subject to our review and approval before being listed publicly.
  • Accept that we may remove or suspend your listing at our discretion if we receive complaints or if your information is found to be inaccurate.
  • Not hold Camberly responsible for the volume or quality of leads or enquiries received through the platform.

10. Privacy

Your use of Camberly is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using Camberly, you consent to the practices described in the Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by South African law:

  • Camberly is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the platform.
  • Our total liability for any claim related to the platform shall not exceed the amount you have paid to us (if any) in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under South African law, including liability for fraud or gross negligence.

12. Indemnification

You agree to indemnify and hold harmless Camberly, its directors, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the platform, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

You may stop using Camberly and delete your account at any time through your profile settings. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your access to the platform at any time, with or without notice, if we reasonably believe you have violated these Terms. Sections 5 through 12 shall survive termination.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of Camberly after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
